Infectious Disease Policy:
I understand and acknowledge on behalf of myself and my child or children who will be attending at Camp Northland in the summer (hereinafter referred to as "my camper") that they may be exposed to infectious disease, including but not limited to Covid-19, respiratory illness, gastro illness, coughs, colds, infections, and flus while at camp. I have discussed the risks with my camper, who wishes to attend camp, nevertheless. For myself and my camper, I accept and assume all such risks, inherent or not, and the consequences of my camper's exposure to or contraction of any such illness or variant and of other infectious disease. I assume such risks even if such loss is caused in whole or in part by the negligence of a Released Party (identified below).
I acknowledge and accept that the Camp shall be entitled in its sole discretion to enact infectious disease protection and health-related policies, including but not limited to, policies that:
1. Require that you, members of your household, and your camper(s), isolate or quarantine, at home and or at Camp, as may be necessary in the interests of the Camp, or as otherwise required at law;
2. Require that campers and staff remain onsite at camp during the entirety of the summer session in which your camper is enrolled;
3. Prohibit visitors from entering the site;
4. Require that Camp operate programs, in accordance with Provincial Guidelines, Ontario Camping Association, and Health Canada guidelines, in consistent cohorts (including staff members) who reside, congregate and participate in programs exclusively within their cohort throughout the entire duration of the program if required, without interactions with members of those outside their designated cohort unless camp policies for interacting with other cohorts are followed;
5. Require that such further and other Health and Safety policies be implemented, including but not limited to mandatory mask use and testing (before and during camp), as may be required at the Camp's exclusive discretion.
6. Require my camper to use facilities only at scheduled times and require that my camper may be required to assist in maintaining a safe camp environment by participating in regular cleaning and sanitization before and/or after the use of certain facilities or equipment at camp, assisting with meal service(s), using household cleaners from time to time, etc.
7. Acknowledge and accept that as a parent I, or a designated member of my household, must remain available to pick up my camper from Camp within 12 hours of being notified by Camp staff, should a positive test or exposure occur.
8. Permit camp staff and the Medical Advisory Committee to follow and interpret Public Health guidelines when making decisions regarding symptoms, a positive test or possible infectious disease exposure (an identified ‘close contact’). This includes but is not limited to treatment, isolation, and/or quarantine and or removal/pick up from camp.
I further understand and acknowledge that programs and/or activities that have historically been offered by the camp will not necessarily run if the camp deems it either unsafe, not preferred or not practical to run for the current summer. This may include but is not limited to camp-wide programs, instructional swim, outtripping programs, ropes course, and hobbies.
The Camp will exercise its discretion to change and adapt policies, activities, and programs as may be required to ensure safe and efficient camp operations. I acknowledge and accept that these policies and changes may be fluid (subject to change) in this context. Any representations made in other collateral materials, marketing representations, or promotional videos are overridden by the current changes to our policies, terms, and conditions for the upcoming summer.
I, Parent/Guardian, for myself and on behalf of my Camper, hereby agree as follows, to the maximum extent allowed by law:
a. To release and not to sue or bring any claim or action against Camp Northland, the Jewish Camp Council of Toronto, their respective owners, Officers, Directors, employees and staff (including volunteers, instructors and clinicians), agents and contractors, individually and in their representative capacities, and their respective heirs ("Released Parties") with respect to any and all claims, demands, actions, causes of action, damages, injuries or losses of any kind which may arise out of, result from, or relate in any way to infectious disease, including the COVID-19 virus during my camper's participation at camp (collectively "claims") arising in whole or part from my Camper's enrollment, attendance at or participation in camp activities, residence at and movement about the camp premises, use of its facilities and equipment, and transportation to and from the camp.
b. to indemnify ("indemnify" meaning to protect and pay claims and damages including costs and lawyers' fees) the Released Parties and each of them, from and against any and all claims, by whomever they might be brought (family members, fellow campers, and others) arising in whole or part from a loss incurred by my camper which may arise out of, result from, or relate in any way to the infectious disease as a result of or in connection with their enrollment, attendance at or participation in camp activities, residence at or movement about the camp premises, use of the camp's facilities and equipment, and transportation to and from the camp.
You acknowledge that you’ve agreed to the Terms and Conditions and may be required to sign off on the Attestation in the days leading up to camp.
You acknowledge that while the camp has a vaccination policy, there could be exceptions, modifications, and/or interpretations related to that policy, which remain at the camp’s sole and absolute discretion and you agree to the camp’s right and ability to do so.
These agreements of release and indemnity include, but are not limited to, claims based in whole or in part on the negligence (but not the gross negligence or intentionally wrongful conduct) of a Released Party, and extend to indemnify each Released party for all costs and lawyers’ fees incurred by each such Released Party.
I have been advised that before signing these Terms and Conditions, I am free to obtain independent legal advice regarding theseTerms and Conditions from a lawyer of my own choice, and I acknowledge that I have had sufficient time to review and seek independent legal advice before signing this agreement.
